There are classes that teach you various aspects of food preparation and creation. Following the instructions and exercises can result in injury. Further, you expressly understand and agree you will not hold Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners liable in any way, without limitation, for any claims, demands, and any kind or nature of damages. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for consequential or incidental damages. 4. Indemnity
You agree to indemnify, hold harmless, and defend Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners from any and all claims, demands, and/or damages, including court costs and attorneys’ fees relating to or arising from your use of the service including, but not limited to, claims for trade disparagement, defamation, intellectual property infringement, privacy and personal injury. You further acknowledge and agree that content contained in sponsor advertisements or information presented to you through the service or advertisers is protected by copyrights, trademarks, patents, service marks, or other proprietary laws and rights. Except as expressly authorized by Contemporary Sushi Inc. you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the service and content, in whole or in part. Collectively content includes but is not limited to, instructions, text, video, images, photographs, databases, html, code, directories, trademarks, logos, and similar information. You may only use the content online solely for your personal, non-commercial use, and you agree to not remove any copyright, trademark, or other notice from such content. You can link to sushigary.com, however, you agree you will remove such link per our request. 7. Member Access
You will receive a username and password for various areas (classes, forums, job boards) of sushigary.com. You accept responsibility for all activities that occur under your account or password, and agree not to sell, transfer or assign your access information or access rights. You expressly understand and agree you are responsible for maintaining the confidentiality of the password and account. You agree to immediately notify support@sushigary.com of any unauthorized use of your password or account. Contemporary Sushi Inc., cannot and will not be liable for any loss or damage arising from your failure to comply.
Sushigary.com classes are good for a period of 30 days from pay date. All sushigary.com content included in the service is provided "as-is" and "as-available (this includes time when the server may be down due to malfunction or maintenance)". You expressly understand and agree that Contemporary Sushi Inc., reserves the right to determine refund eligibility on a case by case basis and that refund decisions are at Contemporary Sushi, Inc.'s sole discretion and are final. Contemporary Sushi, Inc. may also, in our sole discretion, add, delete, or change charges or fees associated with the sushigary.com service at any time.
Contemporary Sushi, Inc. may also, in our sole discretion, change website content and class content at any time. If you are in your 30 day period we will notify you in advance for any class content changes that may affect you. Any notice to you or to sushigary.com shall be made by email. You also agree to allow the Contemporary Sushi, Inc., related entities, representatives, and/or employees access to your account and records to investigate complaints, other allegations, abuse, or for maintenance purposes.

You expressly understand and agree your use of their services is with your own discretion and is your sole responsibility. Contemporary Sushi, Inc., cannot take responsibility for the success or security of transactions undertaken or processed by third parties. You expressly understand and agree that Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners shall not be liable or responsible for any damage or loss of any sort incurred as the result of any dealings with these third party processing agents. Further, you understand and agree to indemnify, hold harmless, and defend Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners from any and all claims and damages relating to or arising from using third party processing agents.

You expressly understand and agree your dealings, communications, correspondence, purchase transactions, or participation through sushigary.com with any third party are solely between you and that third party, even if you arrive at the third parties site by way of sushigary.com. Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners cannot and do not monitor or record all of the material posted or transmitted by users and other third parties. 13. Posting Rules
The sushi forum is intended for users of sushigary.com to discuss sushi related issues or salmon related issues. The job board is intended as a place where sushi chefs can receive leads for jobs specifically dealing with sushi. Postings to the sushi forum or to the job board must strictly adhere to the above mentioned criteria. These boards are intended as real tools for serious users and there is no room in either place to house unrelated information. Postings unrelated to said topics are strictly prohibited and are not welcome in these areas. If you do not adhere to these specific terms you will risk deletion of your postings and will risk being permanently barred from these interactive areas without notice.
You expressly understand and agree that any posting you make to the sushi forum or job board will be related to either the sushi or salmon issues, or is a specifically sushi chef related job lead. Any other use of these forums is strictly prohibited.
You expressly understand and agree you can be held liable for any kind of claim, demand, or damage, including all attorneys fees and court costs arising from your engaging in any of the following non -permissible conduct in these interactive areas:
*posting of topics that are not related to sushi or salmon as determined by the owners of sushigary.com
*posting of non sushi related jobs.
*violating the rights of the owners of sushigary.com or rights of third parties.
*using the sushigary.com service to harm minors in any way.
*violating an kind of laws including but not limited to international, national, and copyright laws.
*engaging in offensive, abusive, or discriminatory behavior.
*uploading viruses or other damaging technologies.
*violating the security of sushigary.com or supporting technologies including but not limited to hosting servers.
*engaging in harassing, stalking, threatening, or flaming behavior.
*impersonating any person or entity, using someone else’s password or account, or misrepresenting yourself.
*spamming of any kind.
*soliciting, advertising, or promoting of any kind unless approved by the owners of sushigary.com (this does not include potential employers who offer real sushi chef jobs to our sushi chef pool ).
*interfering with real time exchanges of other users on the service.
*storing or collect personal information about other users.
14. Registering for interactive areas
When you register for the interactive areas of sushigary.com you expressly understand and agree to provide true, accurate, current and complete information about yourself. You also agree to update your information and keep it current. You expressly understand and agree to indemnify, hold harmless, and defend Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners from any and all claims, demands, and/or damages relating to or arising from any allegation regarding your use of sushigary.com, your use of all related content and the service, information or material posted or transmitted through your membership account, even if it was not posted by you.

Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners do not control, guarantee, represent, or endorse the accuracy, integrity, usefulness, quality, currentness, reliability of any advice, opinion, statement, content, or other information displayed, uploaded, posted or distributed through the sushigary.com service. Under no circumstances and in no event will Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners be liable in any way for any content, including, but not limited to, any omissions or errors in any content, any loss, claim, demand, or damages of any kind incurred as a result of the use of any content posted, transmitted, emailed, or otherwise made available via the service, for any claims, demands, or damages related to unauthorized access to or alteration of your transmissions or data, even if advised of the possibility of such damages, for disputes with third parties including but not limited to, other users, affiliates, or vendors, and for all content that third parties using whatever method make available via the service.

You expressly understand and agree that Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners may establish general practices and limits concerning use of the service, including without limitation the maximum number of days that interactive area content (ie. content on job boards, forums) will be retained by the service. You expressly understand and agree that Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners have no liability or responsibility for the failure to store or deletion of any messages, content and/or other communications transmitted or maintained by the service. You further expressly understand and agree that Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners reserve the right to modify these general practices and limits as needed.
17. Termination
You expressly understand and agree that Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners may, at any time, without prior notice and under certain circumstances immediately terminate your sushigary.com account and access to the service. Cause for termination include, but are not limited to request by you to terminate your account, violations or breaches of the terms of service, requests by government agencies or law enforcement, discontinuance of the service, modification to the service, security issues that are unexpected, and technical issues that are unexpected. Termination of your account includes removal of access to the interactive areas (job boards, forums, etc.) of the site, removal of access to the class sections of the site, deletion of your username, password, other personal information, content, files, postings, etc. that are related to your account or any part thereof, barring further use of the service. You expressly understand and agree that all decisions regarding termination's can be made by Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, and officers in their sole discretion and that Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners are not liable to you or any third party for any termination of your account or access to the service.
18. International Laws
Contemporary Sushi, Inc. and sushigary.com is located, administered, and operated within the United States of America. Contemporary Sushi, Inc. makes no warranties or representations that the services are legal outside the United States. If you are located outside the United States, you are solely responsible for compliance with all applicable international laws. You also agree that you will not violate any US export laws and regulations with your use of the sushigary.com service.
19. Miscellaneous
*You expressly understand and agree Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners reserve the right, in their sole discretion, to change these terms of service at any time and to notify users of any such change solely by changing these terms of service.
*You expressly understand and agree that after posting any amended terms of service your continued use of sushigary.com shall constitute your agreement to be bound by any such changes.
*You expressly understand and agree at any time Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners many end, discontinue, stop, modify, suspend, restrict the sushigary.com service or availability of the sushigary.com service or any portion thereof for any reason whatsoever, without notice, or liability to you or any third party affected by the modification, discontinuance, or suspension of the sushigary.com service.

*You expressly understand and agree in the event that sushigary.com is sold or is otherwise acquired by another entity the owners of sushigary.com retain their right to transfer obligations and rights under this agreement to said entity without notice or liability.
*You expressly understand and agree the section titles used in these terms of service are for convenience only and carry with them no legal or contractual effect.
*You expressly understand and agree these terms of service will be construed and governed in accordance with the laws of the State of California, excluding its conflict of laws principles.
*You expressly understand and agree the exclusive personal jurisdiction of and venue for all disputes arising out of these terms of service shall be the state and/or courts located in Santa Cruz, California, USA. You expressly understand and agree to such exclusive jurisdiction and waive all objections to such jurisdiction and venue.
*You expressly understand and agree any cause of action you may have with respect to Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners, the service, or the terms of service must be filed within three months of the time in which the events giving rise to such claim began, or you agree to waive such claim. You expressly understand and agree no such claim may be brought as a class action.
*You expressly understand and agree in no event shall Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners total liability to you for all damages, losses, and causes of action exceed the amount paid by you to Contemporary Sushi,Inc., if any, that is related to the cause of action.
*If you are a resident of California, you agree to waive California Civil Code Section 1542. Also, under California Civil Code Section 1789.3 users that are residents of California are entitled to the following consumer rights information: The Complaint Assistance Unit of the Division of Consumer Services may be contacted in writing at 400 R St. Suite 1080 Sacramento, CA 95814 or by telephone at (916) 445-1254.
*If any provision of these terms of service are held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to comply with applicable laws, and the remainder shall remain in full force and effect.
*Any failure of Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners to enforce any provision of these terms of service shall not constitute a waiver of any rights under such provision or any other provision of these terms of service.
*You expressly understand and agree, in the event of termination of these terms of service for any reason the provisions regarding limitations on your use of the service and content will survive.
*You expressly understand and agree any licenses you have granted to Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners, and all other provisions for which survival is equitable or appropriate will also survive in the event of termination of these terms of service.
*In the case of conflict between these terms of service and the terms of any other policy or statement, these terms of service shall control.
*You expressly understand and agree these terms of service constitute the sole agreement between Contemporary Sushi, Inc., related entities, creators, owners, directors, employees, agents, content providers, licensers, affiliates, officers, or other partners and you respecting the subject matter hereof and fully supersedes any and all other agreements either oral or in writing. You acknowledge and agree that you have read these terms of service and privacy policy and understand and accept these terms.
*For the purposes of these terms of service, references to including will mean "including, without limitation," unless such reference is already included.
